1. Introduction
As Transistent (Barlas Eğitim Danışmanlık Bilgisayar Hizm. Tercüme Turizm San. ve Dış Tic. Ltd. Şti.), we care for the privacy of our customers and the security of their data. We share what data we collect, the purpose of data collection and your rights in relation to your data in this Privacy Policy.

2. The Data We Collect
The information we request from our customers when they place an order through our website is as follows:

2.1. The use and sharing of the data we collect
The information that customers share with Transistent in the context of this service purchase shall not be shared with third parties.

Transistent may only disclose such information under administrative/legal requirements. If Transistent has the information that is requested from it under any criminal investigation with a documented investigation authorization, it can provide such information to the relevant authority.

Credit card and TR identity number information is not stored. Credit card information is only used to obtain an authorization for the transaction by securely sending such information to the relevant banks during the collection process and is deleted from the system after the authorization is obtained.

Information such as the mail/e-mail address and phone number of the Buyer is only used for standard product delivery and notification procedures by Transistent. Campaign information, information about new products, promotional information can be sent to the buyer from time to time.

2.2. Your Rights in relation to your Personal Data

• The right to learn whether your personal data is processed or not
• The right to request relevant information and copies of documents if your personal data is processed
• The right to learn the purpose for the processing of personal data and whether such data is used for its intended purposes
• The right to know the domestic or foreign third parties to whom personal data is transferred
• The right to request the correction of any incomplete or incorrectly processed personal data
• The right to request the deletion or termination of personal data
• The right to request the correction, deletion or destruction of personal data to be notified to third parties to whom personal data was transferred
• The right to object to the occurrence of a result against you through the exclusive analysis of the processed data by automated systems
• The right to claim compensation for any damages that you may have suffered due to the unlawful processing of personal data
• The right to request that the processing of all or part of your personal data is ceased
• The right to request a copy of your processed personal data in an electronic format and their delivery to another person

3. Changes in our Privacy Policy
Transistent reserves the right to make changes in the Privacy Policy and shall notify the relevant parties in case of any material changes.

Distant Sales Contract

Article 1 - Parties

1.2. Customer: Those who purchased Translation and Language Services via www.transistent.com, and made the payment via any of the payment methods provided in the system.

Article 2 – Subject Matter
The subject matter of this contract is the identification of the rights and obligations of the parties with respect to the services and delivery in relation to the order which is placed by the CUSTOMER via the website of the PROVIDER, www.transistent.com; and the details, features and sales price of which are specified, in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and Regulation on Distant Sales.

The CUSTOMER hereby acknowledges and declares that it was informed by the PROVIDER via the website www.transistent.com, as appropriate on the internet environment, on the name, trade name, full address, phone number and other contact details of the PROVIDER, the basic features of the service that is subject to sale, the sales price including taxes, payment terms, all preliminary information about the service, including the delivery conditions, and the right of "withdrawal", as well as the official authorities and other institutions, with which the CUSTOMER can file their complaints and objections; and that it confirmed such preliminary information in the electronic environment before placing their order.

The preliminary information that is provided on the website, www.transistent.com, and the invoice issued upon the order placed by the CUSTOMER are integral parts of this contract.

Article 3 - Information on the Product which is Subject to the Contract/Payment/Delivery
The grade and type, content, duration, form of delivery, sales price and payment method of the service(s) that are received electronically, the person who shall receive such services, and the delivery address and invoice information for such services are as follows.

The information that the CUSTOMER provides in relation to itself and the order must be accurate and complete. The CUSTOMER agrees to fully indemnify any damages resulting from the inaccuracy or incompleteness of such information, and any liability resulting thereof.

The PROVIDER reserves the right to suspend the order where it deems necessary, and the information provided by the CUSTOMER does not match the facts. Where the PROVIDER discovers problems with the order, the PROVIDER shall suspend the execution of the order for 15 (fifteen) days, if the PROVIDER cannot reach the CUSTOMER via the phone numbers and e-mail addresses provided by the CUSTOMER. The CUSTOMER is expected to contact the PROVIDER in relation to the matter during this period. If no response is received from the CUSTOMER within this period, the PROVIDER shall cancel the order to prevent both parties from being harmed, and shall return any amount paid by the CUSTOMER via the channel, through which the payment was made. The PROVIDER reserves the right to offset any damages it may have incurred due to the order against the amount to be returned, where it deems necessary.

Article 4 - Contract Date and Force Majeure
Contract date is ..../..../........ on which the order is placed by the CUSTOMER. Situations which do not exist or are not foreseen on the date of the execution of the contract; develop beyond the control of the parties; and make it impossible for one or both of the parties to fulfill some or all of their contractual obligations and liabilities or to fulfill them on time, shall be considered as force majeure (natural disaster, war terrorism, uprising, changing legislation provisions, seizure or strike, lockout, significant failure in production and communication facilities, etc.). The party which experiences the force majeure shall immediately notify the other party in writing. The parties shall not be liable for any failure to fulfill their obligations during the course of the force majeure. If such force majeure continues for a period of 30 (thirty) days, each party shall be entitled to unilaterally terminate the contract.

Article 5 - Rights and Obligations of the PROVIDER
The PROVIDER agrees and undertakes to completely fulfill its contractual obligations under all circumstances other than force majeure, as per the provisions of the Law No. 4077 on the Protection of Consumers and Regulation on Distant Sales. People under the age of 18 (eighteen) cannot make any purchases on the website, www.transistent.com. The PROVIDER shall assume that the age informed by the CUSTOMER is true. However, the PROVIDER shall not be liable in any way due to the misrepresentation of the age by the CUSTOMER.
www.transistent.com is not responsible for price errors caused by system errors. As such, the PROVIDER is not responsible for notification or price errors that may occur due to the system or design of the website or illegal interferences in the website. The CUSTOMER cannot make any claims against the PROVIDER based on system errors.
Shopping can be made from www.transistent.com via credit card or money transfer (wire transfer/eft). Orders that are not paid for within one week of the order date are canceled without being processed. The time of processing for the orders is not the time of the placement of the order, but the time when the required amount is collected from the credit card account or the time when the transferred money is determined to have been received by the PROVIDER at its bank accounts. Payment methods such as collect on delivery or mail checks, that are applied without consulting the PROVIDER shall not be accepted.

Article 6 - Rights and Obligations of the CUSTOMER
The CUSTOMER agrees and undertakes to completely fulfill its contractual obligations under all circumstances other than force majeure.
By placing an order, the CUSTOMER agrees and undertakes that it shall be deemed to have accepted the terms of this contract and that it shall make the payment in accordance with the payment method that is specified in the contract.
The CUSTOMER hereby acknowledges and declares that it was clearly informed by the PROVIDER via the website www.transistent.com, as appropriate on the internet environment, on the name, trade name, full address, phone number and other contact details of the PROVIDER, the basic features of the Translation and Language Service that is subject to sale, the sales price including taxes, payment terms, delivery terms and all other preliminary information about the services that are subject to sale, as well as the right of "withdrawal", the conditions under which such right can be exercised, and the official authorities and other institutions, with which the CUSTOMER can file its complaints and objections; and that it confirmed such preliminary information in the electronic environment.
In connection with the previous article, the CUSTOMER declares that they read and was informed of the order and payment conditions for the service, service purchase instructions, the measures that were taken against potential situations and the warnings that were provided on www.transistent.com and that they provided the necessary confirmation in the electronic environment.

Article 7 - Ordering/Payment Procedure

Ordering:
After the value of the service to be received including VAT is approved by the CUSTOMER, the relevant order is sent to the PROVIDER via the system for approval. After the order is also approved by the PROVIDER, an e-mail including the confirmation of the order and payment information is sent to the CUSTOMER.
If the PROVIDER identifies any disruption in the process, any problems in relation the contents of the order (a situation that needs to be corrected or changed in relation to volume, delivery date, total amount, etc.) or any potential problems regarding the credit card payment or money transfer, the PROVIDER shall contact the CUSTOMER via phone, fax and/or e-mail, the details of which are provided by the CUSTOMER, to update the total volume, order value, etc. In case of payment problems, the CUSTOMER may be asked to contact their bank.
The time of processing for the orders is not the time of the placement of the order, but the time when the required amount is collected from the credit card account or the time when the transferred money is determined to have been received by the PROVIDER at its accounts. In line with this condition, the PROVIDER reserves the right to change the date on which the service under this contract is provided, and the delivery date of the service.

Payment:
Customers who do not want to use their credit card information on the internet are provided with the opportunity to order by money transfer (wire transfer/eft) on www.transistent.com. In payment by money transfer (wire transfer/eft), the CUSTOMER can choose the most suitable bank for itself and perform the transfer. The payment is required to have been received by the PROVIDER at its bank account for the order to be processed.
If the CUSTOMER chooses to pay by credit card, the CUSTOMER agrees, declares and undertakes that it shall confirm the possible interest rates and information regarding the default interest from its bank, and that the terms regarding the interest and default interest shall be applied in line with the "Credit Card Agreement" between the CUSTOMER and its bank in accordance with the applicable legislation provisions.

Article 8 - Delivery Procedure/Provision of the Purchased Services
The CUSTOMER is informed of the service details (date of the provision of service, scope and value of the service, etc.) of the order that it wants to place on www.transistent.com, via www.transistent.com.

Delivery:
The delivery time of the order placed by the CUSTOMER is identified by the delivery date that is provided on www.transistent.com based on the details of the service it purchased. However, despite the acceptance and approval of this contract, the order shall not processed until the service value is paid to the PROVIDER's account, and the PROVIDER reserves the right to update the committed delivery date due to the loss of time in this process.
If the PROVIDER fails to commit the delivery of the order within the timeframe requested by the CUSTOMER after reviewing the order request, the PROVIDER is entitled to provide the most appropriate delivery date from its perspective to the CUSTOMER or to cancel the order.
The order can be delivered via e-mail in the digital media or by courier upon the request of the CUSTOMER.

Article 9 - Procedure for Product Returns and the Right of Withdrawal

Right of Withdrawal:
Where the CUSTOMER requests the cancellation of the orders that it approved for processing, the PROVIDER can, in its absolute discretion, charge the fee for the section of the relevant service, which has been completed until then, and cancel the order, unless the force majeure specified in Article 4 of this contract occur.

Article 10 - Warranty
Services that are purchased on www.transistent.com are under the warranty of the PROVIDER. The warranty liability of the PROVIDER is only applicable for consumers who fall within the scope of the Law No. 4077. For commercial works, the provisions of the Turkish Code of Commerce shall apply.

Article 11 - Confidentiality
The information that is provided by the CUSTOMER to the PROVIDER for ordering and payment purposes shall not be shared with third parties by the PROVIDER. The PROVIDER may only disclose such information under administrative/legal requirements. If the PROVIDER has the information that is requested from it under any criminal investigation with a documented investigation authorization, it can provide such information to the relevant authority.

Article 12 - Competent Courts and Enforcement Offices in Case of Disputes
Any dispute arising from the implementation of this contract shall be governed by the Consumer Arbitration Committees for order values that are equal to or below the value which is announced by the Ministry of Industry and Trade every year in December, and the Consumer Courts that are located at the jurisdictions of the CUSTOMER or PROVIDER. If the order is realized, the CUSTOMER is deemed to have accepted all the terms of this contract.
